We has established the following guidelines for derivative works (the “Guidelines”) to ensure that "Kemono Teatime" (the “Product”) is enjoyable and accessible to a broad audience.
Please observe the following guidelines when creating derivative works.
1 Definitions
(1) “Individual” refers to persons who are not employed by or under contract with entertainment or talent agencies, or content creation companies that specialize in distributing content such as video or still images.
(2) “Legal Entity” refers to businesses, and sole proprietors employed by or contracted with entertainment or talent agencies, or content creation companies that specialize in distributing content such as video or still images.
(3) “Customer” refers to anyone enjoying the Product, including those identified above.
2 Scope of Derivative Works
(1) Creation, display, and distribution of Illustrations, manga, stories, etc. (including digital works).
(2) Creation, display, and distribution of character cosplays.
(3) Character cosplay, photography and filming of cosplay, and the display and distribution of cosplay photos or videos.
(4) Creation, display, and distribution of physical items, such as merchandise, accessories, and figures.
(5) Streaming, posting, and sharing videos or still images that make use of video or still images captured during regular gameplay.
* When engaging in any of the above activities, please indicate clearly in your work that it is a derivative creation.
* For "streaming, posting, and sharing videos or still images" as described in item (5), please also ensure you review and understand Section 5, "Regarding Video Streaming and Posting of Images."
3 Eligibility to Engage in Derivative Works
These Guidelines apply exclusively to derivative works created for personal, non-commercial presentation and distribution.
If a Legal Entity wishes to create derivative works or an individual wishes to engage in derivative works that are presumed to exceed the criteria set forth in These Guidelines, please inquire with us directly in advance via this link.
Additionally, Legal Entities may also freely create, publish, and distribute content showcasing The Product that features videos or images captured during normal gameplay, provided this content does not violate the prohibited items set forth in Section 6.
4 Scope of Non-Commercial Purposes
Derivative works are considered non-commercial if they are created by The Customer without a profit motive. Use within the scope of a hobby with compensation or profit only to cover the extent of supply, utility, and similar expenses, falls within the scope of non-commercial purposes. Income from advertising systems on video-sharing sites such as YouTube, etc. is also considered non-commercial.
5 Regarding Video Streaming and Posting of Images
(1) Please respect the experience of other Customers enjoying the Product when streaming video or posting still images.
(2) If a Customer's stream or post content contains spoilers, such as major plot points, please clearly label it with a "Contains Spoilers" indication to be considerate to those who have not played the game yet. Do not include spoilers in titles and thumbnails of videos that are streamed or posted, as they may be unintentionally seen by future players.
(3) If a video stream or post, or still image post is found to contain content deemed to fall under the Prohibited Items set forth by the Company in Section 6, we may pursue legal action, including removal, etc. of the content. We do not individually contribute to, license, or promote videos posted by Customers as official content.
6 Prohibited Items
Customers, regardless of status as Individuals, are prohibited from posting content that corresponds or may correspond to the following:
(1) Conflicts with public order and morality.
(2) Violates the right of a third party.
(3) Promotes specific products, services, political activities, religious activities, etc.
(4) Violates laws and regulations such as criminal acts and antisocial activities, or includes expressions or aims to affirm or encourage such activities.
(5) Can be deemed as non-transformational, such as content that includes scans or tracings, or unaltered use of content from the Product (such as logos, illustrations, videos, sound assets, music, comics, etc.).
(6) Falsely represents sponsorship, authorization, or affiliation with Us, or includes statements that could imply such a relationship.
(7) Is otherwise deemed unsuitable by Us.
If any content violates these prohibitions, We may take legal action at our discretion, including the suspension of publication of the creative work.
Please note that We assume no liability for any loss arising from engaging in derivative works, even if done in accordance with these Guidelines.
Any derivative work that infringes on the rights of others, including the Company’s rights, may result in direct consequences for The Customer involved. Please follow all applicable laws, rules, and common courtesy when engaging in derivative works.
